These Terms of Service govern your use of The Island House Hotel platform, website, and services. By using our services, you agree to these terms in full. Please read them carefully before proceeding.

1. Acceptance of Terms

By accessing, browsing, or using The Island House Hotel website, mobile application, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These terms constitute a legally binding agreement between you and The Island House Hotel B.V., a company incorporated under Dutch law with registration number 12345678, having its registered office at Prinsengracht 263, 1016 GV Amsterdam, Netherlands ("we," "us," or "our").

Age Requirement: You must be at least 18 years old to use our services. By using our platform, you represent and warrant that you meet this age requirement.

The Island House Hotel website, mobile applications, and related digital services.

Any person who accesses or uses our Platform.

"Partner Hotels"

Independent accommodation providers listed on our Platform.

"Booking"

A reservation made through our Platform for accommodation services.

"Content"

All text, images, videos, and other materials on our Platform.

"Services"

All services provided through our Platform, including booking facilitation and customer support.

3. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Platform for personal, non-commercial purposes.

You may not:

  • Modify, copy, distribute, transmit, display, reproduce, or create derivative works from our Platform
  • Use our Platform for any commercial purpose without our written consent
  • Reverse engineer, decompile, or disassemble any software or technology on our Platform
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Use any automated systems (bots, scrapers, etc.) to access our Platform
  • Interfere with or disrupt the integrity or performance of our Platform
  • Access our Platform using methods other than our provided interface

Violation Notice: Any violation of these license terms may result in immediate termination of your access to our Platform and potential legal action.

4. User Accounts

To access certain features of our Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Booking and Reservations

The Island House Hotel acts as an intermediary platform connecting guests with independent hotel operators. All bookings are subject to availability and the individual terms and conditions of each Partner Hotel.

Important Booking Information:

  • • Bookings are confirmed only when you receive our confirmation email
  • • Prices may vary based on dates, availability, and demand
  • • Special requests are subject to hotel availability and may incur additional charges
  • • Check-in and check-out times vary by property

Our Role as Platform:

We facilitate bookings between guests and Partner Hotels but are not the accommodation provider. Each Partner Hotel is responsible for:

  • The quality and condition of accommodations
  • Service standards and guest experience
  • Compliance with local regulations and safety standards
  • Handling of complaints and issues during your stay
  • Provision of amenities and services as advertised

6. Payment Terms

Payment processing is handled securely through our certified payment partners. We accept major credit cards, debit cards, and other payment methods as displayed during checkout.

  • • Visa, Mastercard, American Express
  • • PayPal and digital wallets
  • • Bank transfers (for certain bookings)
  • • iDEAL (Netherlands)
  • • SEPA Direct Debit

Payment Security:

  • • 3D Secure authentication
  • • Fraud detection systems
  • • No card details stored on our servers

Pricing and Fees:

  • All prices are displayed in Euros (EUR) unless otherwise specified
  • Prices include applicable taxes (VAT) as required by law
  • Additional fees (city tax, resort fees) may apply and are payable directly to the hotel
  • Currency conversion fees may apply for non-EUR transactions
  • Prices are subject to change until booking confirmation

Important: Final charges may appear on your statement in the currency of our payment processor. Exchange rates are determined by your bank or card issuer.

7. Cancellation Policy

Cancellation policies vary by Partner Hotel and are clearly displayed during the booking process. Please review the specific cancellation terms for your booking before confirming your reservation.

Cancellation Process:

  1. Log into your account or use the cancellation link in your confirmation email
  2. Locate your booking using the reference number
  3. Review the applicable cancellation terms and fees
  4. Confirm the cancellation request
  5. Receive cancellation confirmation via email

Refund Processing:

Approved refunds are processed within 5-10 business days to the original payment method. Processing times may vary depending on your bank or card issuer.

8. User Conduct

You agree to use our Platform responsibly and in accordance with applicable laws. The following activities are strictly prohibited:

Prohibited Activities:

  • • Making false or fraudulent bookings
  • • Using the Platform for illegal activities
  • • Harassing other users or staff
  • • Posting offensive or inappropriate content
  • • Attempting to hack or compromise security
  • • Creating multiple accounts to circumvent restrictions
  • • Commercial use without authorization

Expected Behavior:

  • • Provide accurate booking information
  • • Respect Partner Hotels and their staff
  • • Follow hotel policies and local laws
  • • Report issues through proper channels
  • • Protect your account credentials
  • • Use the Platform as intended
  • • Respect intellectual property rights

Enforcement:

Violations of these conduct rules may result in account suspension, booking cancellation, legal action, and reporting to relevant authorities. We reserve the right to refuse service to anyone who violates these terms.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Service.

As a European company, we comply fully with the General Data Protection Regulation (GDPR). You have the following rights:

Copyright Infringement:

If you believe that any content on our Platform infringes your copyright, please contact us with the following information:

  • A statement of good faith belief that the use is not authorized
  • A statement of accuracy and authority to act on behalf of the copyright owner

11. Disclaimer of Warranties

Our Platform and services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

Service Disclaimers:

  • • Quality of Partner Hotel services
  • • Accuracy of hotel descriptions

We make no warranties regarding the accuracy, reliability, or completeness of information provided by Partner Hotels. Each hotel is solely responsible for the accuracy of their property information, rates, and availability.

12. Limitation of Liability

LIABILITY LIMITATION

Our liability is limited as described below. These limitations apply to the fullest extent permitted by law.

To the maximum extent permitted by applicable law, The Island House Hotel, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Cost of substitute goods or services
  • Personal injury or property damage
  • Emotional distress or mental anguish
  • Business interruption or loss of use

Maximum Liability Cap:

Our total liability for any claims arising from your use of our Platform shall not exceed the total amount paid by you to us in the 12 months preceding the claim, or €100, whichever is greater.

Exceptions:

These limitations do not apply to liability that cannot be excluded or limited under applicable law, including:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Violations of your fundamental rights
  • Other liability that cannot be excluded by law

13. Indemnification

You agree to defend, indemnify, and hold harmless The Island House Hotel, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use or misuse of our Platform
  • Your violation of these Terms of Service
  • Your violation of any third-party rights
  • Any false or misleading information you provide
  • Your conduct in connection with our services
  • Any damage you cause to Partner Hotels or other users

Note: This indemnification obligation survives termination of these Terms and your use of our Platform.

14. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your access to our Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Grounds for Termination:

  • • Fraudulent or illegal activity
  • • Non-payment of fees
  • • Abuse of our Platform or staff
  • • Extended account inactivity
  • • Legal or regulatory requirements

Effect of Termination:

  • • Immediate loss of access
  • • Existing bookings remain valid
  • • Account data may be deleted
  • • Outstanding obligations survive
  • • Right to refund as applicable
  • • License termination

Survival:

The following sections survive termination of these Terms: Payment Terms, Intellectual Property Rights, Disclaimer, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

15. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Amsterdam, Netherlands.

Alternative Dispute Resolution

Before pursuing formal legal action, we encourage you to contact us to seek a resolution. We are committed to working with you to resolve any disputes amicably.

Consumer Protection:

If you are a consumer resident in the European Union, nothing in these Terms affects your statutory consumer rights under applicable consumer protection laws.

16. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
